Debt Recovery Explained
A transparent look at how the process really works, for businesses and customers alike.
Debt collection often gets a bad reputation, but much of what people think they know simply isn’t true. At UK Search Limited, we believe in transparency to help cut through misconceptions and give you the facts.
Let’s clear some of these up, shall we?
When you know what the process really involves, you can feel more in control and confident about your options. Instead of guessing or fearing the worst, you’ll have a clear picture of your rights, the steps ahead, and the support available to help you find a solution that works.
Does ignoring your debt make matters worse?
If you ignore communications about your debt, matters will get worse. Creditors or debt collection agencies will continue to try and contact you by letters, phone calls, emails and SMS. Some creditors may continue to claim interest on unpaid amounts meaning your debt will increase. If you ignore your debts, you could end up with a default being registered against your credit file. If you continue to ignore the situation, some creditors or debt collection agencies may take legal action against you, which could result in a County Court Judgment (CCJ) being registered against you, which, if you still ignore the situation, may result in enforcement action being taken. When legal and enforcement action takes place, a creditor or debt collection agency will claim court costs and solicitor fees, increasing your debt further.
It is strongly advised that you get in touch with any creditor or debt collection agency that is trying to contact you at the earliest possible stage. They will consider your circumstances and if you cannot pay a debt in full, they will help you to make a suitable payment plan based on your circumstances.
You can also get free independent debt advice. A list of these can be found by clicking this link. If you are actively seeking debt advice, please let your creditor or debt collection company know so they can place a hold on your case to give you time to get the appropriate advice.
It’s not about confrontation, it’s about connection. Let’s change the narrative together.
Will a collection company listen to my circumstances?
It is in your interest to pay your debts as soon as you can to become debt free. So, if you can pay in full without affecting other priority bills, then you should. If you cannot do that, then the debt collection company will consider your circumstances, and they will help you to make a suitable payment plan based on your circumstances. The payment arrangement will be agreed with you to try and clear the debt as soon as is reasonably possible.
Do I need to tell a debt collection company if I move house?
If you do not advise a debt collection company of your new address, then further debt collection action may continue at your last known address. This means that the debt could escalate without your knowledge, which could result in legal action taking place and a County Court Judgment being obtained. If you are found to have moved without advising the debt collection company, the debt collection company will attempt to trace you. In most cases, this will mean searching credit reference agency data to locate your new address.
Are social media pages and online forums helpful?
The advice found on online forums is often inaccurate or misleading. Each situation is different, and what works for one person may not be right, or even legal for another. Following poor advice can make your situation worse. Seeking help from qualified debt charities or financial advisors is the safest option.
